Healthy Valley Magazine Healthy Makeover CHALLENGE RULES
OPEN TO ALL LEGAL FEMALE RESIDENTS WHO ARE THE AGE OF MAJORITY (18 YRS) IN THE Rio Grande Valley. ENTRY IN THIS CHALLENGE CONSTITUTES ACCEPTANCE OF THE CHALLENGE RULES
1.ENTRY SUBMISSION PERIOD. Entry submissions will be accepted beginning February 1, 2010. The deadline for Entry Submissions is 11:59p.m. CST April 25, 2010.
2.ELIGIBILITY. This challenge is open to legal female residents of the Rio Grande Valley who are at least 18 years old as of the date of entry, except officers, directors or employees of the Sponsor, any other party associated with the development or administration of this challenge, and the immediate family (i.e., parents, children, siblings, spouse) and persons residing in the same household as such individuals.
3.HOW TO ENTER. Visit www.healthyvalleyonline.com during the Entry Submission Period and follow the instructions to complete and submit the entry form. All applicants must submit a recent picture (within the last 6 months). Entry Forms, essay and pictures can also be mailed to Healthy Valley Magazine (801 East Fern Ave., Suite 131, McAllen, TX 78572). There is a limit of one (1) entry per person. All entries and pictures become the sole property of the Sponsor and will not be returned for any reason. Entries will be declared invalid if they are late, illegible, incomplete or damaged. Entries received online shall be deemed submitted by the authorized account holder of an email address associated with the entry.
4.CONTESTANT SELECTION AND NOTIFICATION. Contestant selection will be completed by a panel of judges, from all eligible entries. Only one (1) of the contestants will be chosen for the Healthy Makeover Challenge and will be notified by telephone on or about Monday April 20th, 2010. Upon notification, the selected entrant must respond by telephone to the contact number provided in the notification, and the selected entrant’s response must be received by the Sponsors within 24 hours from the date the Sponsor first tries to notify her. If the selected entrant does not respond in accordance with the Challenge rules, she will be disqualified. Upon contacting a contestant and determining that she has met all eligibility requirements of the challenge, including without limitation the execution of required waivers, publicity and liability releases and disclaimers, such individual will be declared the winner.
5.CHALLENGE VOTING. At the begging of each week, starting Monday April 5, 2010, one finalist will be chosen and will be announce on the website every Friday therefore. On April 26 , 2010, a last finalist will be chosen and a final selection of the winner will be done on April 30th, 2010.tire 4 finalist. The winner will be announced on la Salud Del Valle Television Show on Friday May 7th, 2010, and the makeover will begin on May 13th 2010, for a period of 4 months.
6.CHALLENGE PERIOD. The Healthy Makeover Period will start May 13th, 2010, and will end on September 10th, 2010.
7.PRIZE DESCRIPTION. The winner will participate in a fitness, health and beauty makeover. The winner will receive a gym membership and weekly weight loss program for a period of 4 months, and a dental makeover, Botox session, and makeup and hair makeover. All of this prizes will be included on a personalize and tailored to the winner’s personality and goals. All the services will be provided at the discretion of our sponsors and advertisers.
8.ODDS OF WINNING. The odds of winning this Promotion depend on the number of eligible entries received.
9. NO PRIZE TRANSFER OR SUBSTITUTION. No prize or any portion thereof is transferable or redeemable for cash. Any portion of the prize that is not used is forfeited.
10. RELEASE. The winner of the contest will be required to execute a legal agreement and release (“Release”) that confirms Contestant’s: (i) eligibility for the Challenge and compliance with these Challenge Rules; (ii) acceptance of the prize as offered; (iii) release of each of the Sponsors and their respective parent companies, subsidiaries, affiliates, employees, directors, officers, suppliers, agents, sponsors and administrators (collectively, the “Releasees”) from any and all liability for any loss, harm, damages, cost or expense arising out of participation in this Challenge, participation in any Challenge-related activity or the acceptance, use, or misuse of any prize, including but not limited to costs, injuries, losses related to personal injuries, death, damage to, loss or destruction of property, rights of publicity or privacy, defamation, or portrayal in a false light, or from any and all claims of third parties arising there from; and (iv) grant to Sponsors of the unrestricted right, in the Sponsors’ collective or individual discretion, to produce, reproduce, publish, broadcast, communicate by telecommunication, exhibit, distribute, adapt and otherwise use or re-use the Contestant’s name, photograph, likeness, voice and biography, in any and all media now known or hereafter devised, in connection with the Challenge and the promotion and exploitation thereof. The executed Release must be returned within two (2) business days of the verification process.
11. INDEMNIFICATION BY ENTRANT By entering the Challenge, entrant releases and holds Releasees harmless from any and all liability for any injuries, loss or damage of any kind to the entrant, Releasees or any other person, including personal injury, death, or property damage, resulting in whole or in part, directly or indirectly, from acceptance, possession, use or misuse of any prize, participation in this Challenge, any breach of these Challenge Rules, or in any prize-related activity. The entrant agrees to fully indemnify Releases from any and all claims by third parties relating to the Challenge, without limitation.
12. LIMITATION OF LIABILITY Sponsors assume no responsibility or liability for lost, late, misdirected or incomplete Entries, notifications, responses, replies or any Release, or for any computer, online, telephone, hardware, software or technical malfunctions that may occur, including but not limited to malfunctions that may affect the transmission or non-transmission of an Entry. Sponsors are not responsible for any incorrect or inaccurate information, whether caused by website users or by any of the equipment or programming associated with or utilized in the Challenge or by any technical or human error which may occur in the administration of the Challenge. Sponsors assume no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of, Entries. Sponsors are not responsible for any problems, failures or technical malfunction of any telephone network or lines, computer online systems, servers, providers, computer equipment, software, e-mail, players, or browsers, on account of technical problems or traffic congestion on the Internet, at any website, or on account of any combination of the foregoing. Sponsors are not responsible for any injury or damage to entrant or to any computer related to or resulting from participating or downloading materials in this Challenge. Entrant assumes liability for injuries caused or claimed to be caused by participating in the Challenge, or by the acceptance, possession, use of, or failure to receive any prize. Sponsors assume no responsibility or liability in the event that the Challenge cannot be conducted as planned for any reason, including those reasons beyond the control of the Sponsors, such as infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or corruption of the administration, security, fairness, integrity or proper conduct of this Challenge or the Challenge Website. •13.CONDUCT By entering this Challenge, entrant agrees to be bound by these Challenge Rules, which will be posted at the Challenge Website throughout the Challenge Period. Entrant further agrees to be bound by the decisions of the judges and Sponsors, which shall be final and binding in all respects. Sponsors reserve the right, in their sole discretion, to disqualify any entrant found to be: (a) violating the Challenge Rules; (b) tampering or attempting to tamper with the entry process or the operation of the Challenge the Challenge Website, or any canada.com website; (c) violating the terms of service, conditions or use and/or general rules or guidelines of any canada.com property or service; and/or (d) acting in an unsportsmanlike or disruptive manner, or with intent to annoy, abuse, threaten or harass any other person. CAUTION: ANY ATTEMPT TO DELIBERATELY DAMAGE THE CHALLENGE WEBSITE OR ANY RELATED WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE CHALLENGE MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS. SHOULD SUCH AN ATTEMPT BE MADE, SPONSORS RESERVE THE RIGHT TO SEEK REMEDIES AND DAMAGES TO THE FULLEST EXTENT PERMITTED BY LAW, INCLUDING BUT NOT LIMITED TO CRIMINAL PROSECUTION.•
14.PRIVACY AND USE OF PERSONAL INFORMATION By entering this Challenge, entrant grants to the Sponsors the right to: (a) use her personal information for the purpose of administering the Challenge; (b) use her name, photograph, likeness, voice, prize information and/or biographical information for publicity and promotional purposes without further compensation unless prohibited by law; and (c) use her name and her respective city and province of residence in connection with the Challenge Website, other related websites and/or in any other media now known or hereafter devised. Furthermore, entrant consents to the Sponsors’ use of her name, e-mail address and telephone number for the purpose of sending the entrant information about the Sponsors’ products and/or services, and contacting the entrant about future sales and marketing promotions. In addition, the Sponsors may disclose the entrant's name, e-mail address and telephone number to third-party agents and service providers of any of the Sponsors in connection with any of these activities.
15.INTELLECTUAL PROPERTY All intellectual property, including but not limited to trade-marks, trade names, logos, designs, promotional materials, web pages, source code, drawings, illustrations, logos, slogans and representations are owned by the Sponsors and/or their affiliates. All rights are reserved. Unauthorized copying or use of any copyrighted material or intellectual property without the express written consent of its owner is strictly prohibited.
16.TERMINATION Sponsors reserve the right, in their sole discretion, to cancel, amend, modify or terminate all or any portion of this Challenge at any time for any reason without prior notice.
17.LAW These are official Challenge Rules. This Challenge is subject to applicable federal, provincial and municipal laws and regulations. These Challenge Rules are subject to change without notice in order to comply with any applicable federal, provincial and municipal laws or the policy of any other entity having jurisdiction over the Sponsors.
